Overview
Welcome to 7Hertz. In these terms, "we", "us" and "our" mean 7 Hertz AVL Trading L.L.C (Trade Licence No. 1643152) ("7Hertz"). 7Hertz runs this online store and website, including all information, tools, products and services on it (the "Services"). Our online store is powered by Shopify.
These Terms of Service ("Terms"), together with the policies linked in them, explain your rights and responsibilities when you use the Services.
Please read these Terms carefully. They include important information about warranties and the limits of our responsibility.
By visiting or using our Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.
1. Your account
To use the Services, you must be at least 18 years old, or be buying for a registered business with authority to do so.
We may ask for your name, company name, email, phone number, billing and delivery address, and payment details. Business customers may also be asked for a trade licence or TRN. You agree that all information you give us is true, up to date and complete.
You are responsible for keeping your login details safe and for everything done using your account. You may not sell or transfer your account to anyone else.
2. Our products
We try to show our products accurately. Colours and appearance may look different on your screen because of your device and its settings.
We cannot promise that a product will look exactly as shown in our store. Product details and specifications come from the manufacturers and may change without notice. We may stop selling any product, or limit the quantity sold to any person or region.
It is your responsibility to check that a product is suitable for your use or project. If you are not sure, please contact us before you order.
3. Orders
When you place an order, you are offering to buy. Your order is only accepted when we confirm it and receive your payment. We may refuse any order for any reason.
Please check your order carefully before you submit it. After we accept an order, we may not be able to cancel it. If we refuse, change or cancel your order, we will contact you using the email, phone number or address you gave us, and refund any payment for that order.
Returns and exchanges follow our Refund Policy.
You may buy for personal use, business use, rental or installation projects. If you take products outside the UAE, you must follow all export and import laws.
4. Prices and payment
Prices are shown in UAE Dirhams (AED). Prices, discounts and offers can change without notice. The price you pay is the price shown when you place your order, as stated in your order confirmation email.
7Hertz is registered for VAT in the UAE. UAE VAT (currently 5%) is added at checkout where it applies, and we send a tax invoice for every order. Orders shipped outside the UAE may be zero-rated for UAE VAT where the law allows. Unless we say otherwise, prices do not include shipping, handling, customs duties or import charges.
Online prices may be different from prices given by our sales team or by other sellers. Some promotions have their own terms. If they conflict with these Terms, the promotion terms apply.
All payments are made online at checkout, using the payment methods shown there (such as credit and debit cards, Apple Pay and Google Pay). You confirm that the payment details you give are correct and that you are allowed to use that payment method. You agree to pay all charges at the prices shown, including VAT and shipping. Please keep your account and payment details up to date.
5. Shipping and collection
We ship within the UAE, to GCC countries and to other countries. Shipping costs and estimated delivery times are shown at checkout. For orders outside the UAE, you are responsible for any customs duties, import taxes and charges in your country, unless we say otherwise.
Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs or events outside our control.
You can also collect your order from our warehouse in Dubai Silicon Oasis after we tell you it is ready.
Ownership and risk pass to you when we hand the products to the carrier, or when you (or someone you send) collect them. Please check your order when it arrives and tell us about any damage or missing items within 48 hours.
6. Clearance and ex-demo items
Clearance items are limited and sold on a first come, first served basis. Ex-demo items have been used for demonstrations and may show signs of use. They are sold as is, in the condition described. Please check item codes and specifications before you buy. Clearance items cannot be returned unless they are faulty on arrival.
7. Warranty and repairs
Products come with the manufacturer's warranty. The length and terms depend on the brand and product. We will help you make a warranty claim with the manufacturer.
The warranty does not cover damage caused by misuse, wrong installation, accidents, power problems, water, normal wear, or repairs made by anyone not approved by us or the manufacturer.
8. Safety of flown equipment
Flying brackets, hoist chains, mounts and any equipment that is hung or flown must only be installed, used and inspected by trained and qualified people. You must follow the manufacturer's instructions, load limits and all local safety rules. We are not responsible for injury, damage or loss caused by wrong installation, overloading or poor maintenance.
9. Training and services
Training sessions, masterclasses, system design and technical support have their own booking details or written proposals, which we will share with you. If they conflict with these Terms, those details apply.
10. Our content and trademarks
Everything in our Services, including trademarks, text, images, videos and page design, belongs to 7Hertz, our partners or the brands we sell. It is protected by UAE and international intellectual property laws.
You may use our Services to view products, research and buy for your personal or business needs. You may not copy, publish, sell, change or download our content for other uses without our written permission.
The 7Hertz name and logo belong to 7Hertz. Shopify's name and logo belong to Shopify. Brand names and logos of the manufacturers we sell, such as DiGiCo and DPA, belong to those manufacturers.
11. Optional tools
We may give you access to tools from other companies as part of the Services. We do not control these tools. They are provided "as is", without any promise from us, and you use them at your own risk. Please read the terms of the company that provides each tool.
We may add new features to the Services in the future. These Terms will also apply to them.
12. Links to other websites
Our Services may include links to websites run by other companies, such as manufacturer websites. We do not check or control them, and you visit them at your own risk.
We are not responsible for any harm or loss related to other websites, or for anything you buy from them. Please read their policies before you buy, and send any complaints about their products to them.
13. Shopify
Our online store is powered by Shopify, but when you buy from our store, you buy directly from 7Hertz. Shopify is not responsible for any part of your purchase, including any injury, damage or loss caused by products you buy. You agree not to make any claims against Shopify about your purchases from 7Hertz.
14. Privacy
We handle your personal information as explained in our Privacy Policy. Some information may also be handled under Shopify's Privacy Policy.
Because our store is hosted by Shopify, Shopify collects and uses information about how you use the Services so it can run and improve them. Your information may be shared with Shopify, our brand partners and service providers, including in other countries, so we can serve you.
15. Reviews and feedback
If you send us reviews, ideas or suggestions ("Feedback"), we may use, edit and publish them anywhere, for any purpose, including marketing, without paying you. We do not have to keep Feedback private or reply to it.
Your Feedback must be honest and your own. You must tell us if you received anything in return for it. It must not be illegal, offensive, false or harmful, contain viruses, or break anyone's rights, and you must not use a false name or email. You are responsible for your Feedback.
We may check, edit or remove any Feedback that we think breaks these rules.
16. Mistakes on our website
Sometimes our Services may have mistakes in product details, prices, offers, shipping charges, delivery times or stock. We may correct these mistakes at any time without notice. If a mistake affects your order, we may cancel it, even after you have placed it, and refund any payment.
17. What you must not do
You may only use the Services for lawful purposes. You must not:
- use the Services for anything illegal or harmful
- break any law or regulation
- break our intellectual property rights or anyone else's
- harass, insult, threaten or harm our staff or anyone else
- give false or misleading information, or pretend to be someone else
- send spam, junk mail, chain letters or advertising
- upload viruses or harmful code
- copy, sell or misuse any part of the Services
- collect or track other people's personal information
- phish or use other tricks on the Services
- use bots, scrapers, data-collection tools or AI tools to access the Services
- get around our security or access limits
- do anything that stops others from using the Services, or that may harm 7Hertz, Shopify or our users
If you break these Terms, we may suspend or close your account without notice.
18. Automated agents and AI tools
An "Agent" is any software, including AI tools, that acts on its own or on someone's behalf without direct human control.
An Agent may only use our Services if it always follows these rules, and only if we have not asked it to stop. An Agent must:
- include "Agent/[agent name]" in the user agent of every web request
- not hide that it is an Agent, for example by copying human behaviour or solving CAPTCHAs
- answer truthfully if asked whether it is a human or a computer
- not get around any limits we set on Agents
We may limit or block any Agent at any time, including by technical means.
19. Ending your access
We may end these Terms or stop your access to the Services at any time, without notice. You must still pay any amounts you owe up to that date.
The sections on content and trademarks, feedback, disclaimer, limits of our responsibility, your responsibility to us, general terms, governing law and privacy will still apply after that.
20. Disclaimer
Information in our Services is for general guidance only. We do not promise it is complete, accurate or useful, and you rely on it at your own risk.
Except where 7Hertz clearly says otherwise, the Services and all products are provided "as is" and "as available", without any promises. Apart from the manufacturer's warranty in Section 7, we make no promises about products, including that they are fit for a particular purpose. We do not promise that the Services will always work without errors or interruption. This does not affect any rights you have under UAE law that cannot be removed.
21. Limit of our responsibility
As far as the law allows, 7Hertz, Shopify and our staff, partners and suppliers are not responsible for any indirect or consequential loss from using the Services or any product. This includes lost profits, lost income, lost savings, lost data, replacement costs or similar losses, even if we were told they might happen.
Our total responsibility for any claim is limited to the amount you paid for the product or service that the claim is about.
22. Your responsibility to us
You agree to protect 7Hertz, Shopify and our staff, partners and suppliers from any claims, losses or costs (including reasonable legal fees) caused by:
- you breaking these Terms
- you breaking any law or someone else's rights
- your use of the Services
We will tell you about any such claim. We may manage the defence ourselves at your cost, but we will not agree a settlement that needs you to do something other than pay, without your consent. You agree to help us, including by giving us relevant documents.
23. General terms
If part of these Terms is invalid: that part is removed or limited, and the rest still applies.
If we do not enforce a right: it does not mean we give up that right.
Whole agreement: these Terms and the policies on our website are the full agreement between you and us about the Services. They replace any earlier versions.
Transfer: you may not transfer your rights under these Terms without our written permission. We may transfer ours without telling you.
Headings: headings are only there to make the Terms easier to read.
24. Governing law
These Terms are governed by the laws of the United Arab Emirates, as applied in the Emirate of Dubai. Any dispute will be handled by the courts of Dubai.
25. Changes to these Terms
You can always read the latest version of these Terms on this page. We may update them at any time by posting changes on our website, so please check this page from time to time. For important changes, we will tell you as required by law. If you keep using the Services after a change, it means you accept it.
